According to Section 12A of the Toll Roads Law (Carmel Tunnels), 1995 (hereinafter: “the Law”) – anyone who disputes a charge or considers themselves harmed by the exercise of the concessionaire’s powers under the Law may, within 45 days of receiving the charge notice or from the date the powers are exercised, appeal to the Appeal Committee.
In accordance with Section 12A of the Law, the Appeal Committee consists of three members appointed by government ministers. The Appeal Committee is authorized, among other things, to accept (in whole or in part) or reject the appeal, and may also impose procedural costs on the parties (all or some of them). A final decision by the Appeal Committee may be appealed by submitting a request for permission to appeal to the District Court.
The company “Cross Israel Highway Ltd.,” which is the authority responsible for the Carmel Tunnels project, operates the secretariat of the Carmel Tunnels Appeal Committee.
